WildHeart Riding School (“WildHeart,” “we,” “us,” or “our”) reserves the right to amend or update these Terms of Service (“Terms”) at any time without prior notice. The most current version will always be available on our website.
By entering our property, interacting with our horses, participating in recreational equine therapy, or engaging with any activities offered by WildHeart (collectively, the “Services”), you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If the participant is a minor, the parent or legal guardian accepts these Terms on the minor’s behalf.
1. Mission Statement
Our mission goes beyond riding. Through the power of horses, we help kids and families develop patience, emotional awareness, empathy, confidence, and critical thinking. Horses create a unique environment where growth, healing, and connection happen naturally.
2. Recreational Equine Therapy Program
2.1 Program Description
WildHeart’s recreational equine therapy program supports emotional, behavioral, and developmental growth through structured, non-clinical interactions with horses. While therapeutic in nature, WildHeart’s services do not diagnose, treat, or provide clinical mental health or medical care.

2.2 Eligibility
WildHeart reserves the sole discretion to determine whether an individual is appropriate for participation. Safety of participants, staff, and horses is our top priority. We may discontinue or modify participation if necessary.
3. Scheduling, Attendance & Payment Policies
3.1 Timeliness
- Participants must arrive on time for scheduled sessions.
- Sessions end at their originally scheduled time, regardless of late arrival.
- No time extensions or partial refunds are provided for tardiness.
3.2 Prepayment Requirement
- All recreational equine therapy clients must pay for four (4) sessions in advance.
- Sessions will not be scheduled or reserved until payment is received in full.
3.3 Cancellation, No-Show & Rescheduling Policy
To protect the mental and physical wellbeing of our horses and respect our staff’s time:
- No rescheduling is allowed within 48 hours of a session.
- Sessions canceled, missed, or rescheduled within 48 hours are forfeited.
- Sessions canceled more than 48 hours in advance may be rescheduled based on availability.
- All payments are non-refundable, including unused sessions.
- WildHeart may reschedule sessions for safety concerns (weather, horse welfare, facility conditions), but is not obligated to make exceptions.
4. Assumption of Risk
4.1 Inherent Risks of Equine Activities
Participants acknowledge that equine activities involve inherent risks, including but not limited to:
- unpredictable animal behavior
- kicking, biting, bucking, or sudden movements
- falls from, or while handling, horses
- uneven terrain, mud, insects, and environmental hazards
- equipment failure
- actions of other participants or visitors
By entering the WildHeart property or participating in equine activities, you voluntarily assume all inherent risks.
4.2 Safety Compliance
Participants and visitors must follow:
- all staff instructions
- all posted signs
- helmet and footwear requirements
- behavioral rules around horses
WildHeart may remove any participant or guest who behaves unsafely, without refund.
5. Waiver, Release, Hold Harmless & Indemnification
(Updated with Florida Equine Activity Liability Act language)
5.1 Florida Statutory Warning (REQUIRED BY LAW)
Florida Statutes § 773.04 require the following warning to be provided exactly as written:
“WARNING: Under Florida law, an equine activity sponsor or equine professional is not liable for an injury to, or the death of, a participant in equine activities resulting from the inherent risks of equine activities.”
This applies automatically to all activities conducted by WildHeart.
5.2 Waiver & Release
To the fullest extent permitted by law, you fully and forever waive, release, and discharge WildHeart Riding School, its owners, officers, employees, contractors, volunteers, agents, and property owners (the “Released Parties”) from any and all claims arising out of or related to:
- participation in equine or farm activities
- presence on the WildHeart property
- injuries, death, illness, or property damage
5.3 Hold Harmless
You agree to hold harmless the Released Parties from any claims brought by you, your family, your minor child, your guests, or any third party connected to your participation.
5.4 Indemnification
You further agree to indemnify and defend the Released Parties against any claims—including attorneys’ fees and costs—arising from:
- your actions or omissions
- your minor child’s actions or omissions
- your guests’ actions or omissions
- violation of these Terms
- failure to follow safety rules
This obligation survives termination of participation.
5.5 Acknowledgment of Inherent Risk
You understand that injuries or death can result from equine activity and assume all associated risks as defined by Florida law.
6. Guest Policy & Mandatory Liability Waiver
6.1 Definition of Guest
A “guest” is any individual entering the property who is not the scheduled participant—friends, family, observers, or visitors.
6.2 Mandatory Waiver for All Guests
Every guest must sign a Hold Harmless Agreement before:
- stepping near the barn
- approaching or interacting with horses
- observing or participating in activities
The waiver must be signed each time the guest visits.
6.3 Responsibility of Rider / Account Holder
It is the participant’s responsibility to ensure all of their guests sign the waiver prior to entering the barn area or interacting with horses.

7. Confidentiality
WildHeart respects participant privacy. All personal, behavioral, or emotional information shared during sessions is treated as confidential unless:
- required by law
- necessary to prevent harm
- needed for emergency response
- permitted by written consent of the parent/guardian
8. Media & Photography Policy
- No photos or videos may be taken during sessions without explicit staff approval.
- If you sign a media release, WildHeart may use imagery for marketing or educational purposes until consent is revoked in writing.
- Unauthorized recording of staff, participants, or horses is prohibited.
9. Parents & Guardians of Minors
For minors:
- A parent or guardian must remain on the property unless otherwise approved.
- Siblings not participating must be supervised at all times.
- Parents are expected to support attendance, punctuality, and communication.
10. Animal Welfare & Session Adjustments
WildHeart may adjust, shorten, reschedule, or substitute horses if:
- a horse shows signs of fatigue, stress, or medical concern
- weather conditions pose risk
- facility conditions require adjustment
- participant behavior jeopardizes safety
Safety of horses, participants, and staff takes priority over scheduled activities.
11. Property Rules & Responsibility for Personal Items
All participants and guests agree to:
- stay in designated areas
- avoid restricted zones
- move calmly around horses
- follow parking and property access instructions
WildHeart is not responsible for lost, stolen, or damaged personal belongings.
12. No Guarantee of Results
Each participant’s experience is unique. WildHeart does not guarantee any specific emotional, developmental, or behavioral outcome from participation in recreational equine therapy.
13. Governing Law
These Terms are governed by the laws of the State of Florida.
14. Acceptance of Terms
By entering the property, booking or attending sessions, signing any waiver, or allowing a minor child to participate, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, including the Waiver, Release, Hold Harmless, and Indemnification provisions.
